Family of baseball star Tony Gwynn files lawsuit against Tobacco company

SAN DIEGO (KUSI) — The family of the late Tony Gwynn is taking legal action against the tobacco industry.

The family filed a lawsuit in San Diego Superior Court, saying tobacco companies "manipulated" Gwynn into using smokeless tobacco starting when Gwynn was a college player at San Diego State.

Then, for 31 years, he used up to two cans per day. That's the equivalent of five packs of cigarettes every day.

According to the New York Times, there are no damages specified in the complaint, which asks for a jury trial on grounds of negligence, fraud and product liability. 

The complaint states, “This case seeks to hold them responsible for killing a baseball legend and a wonderful human being.” 

NYTimes reports the complaint said that Gwynn, while in college, was the victim of a scheme to get him addicted to smokeless tobacco, while knowing the dangers it posed to him. 

"Now that the family understands how he was targeted, they understand that the industry knew they had this highly carcinogenic product and they were marketing it to people like Tony," said David S. Casey, the lead lawyer for the plaintiffs. "They want to hold them accountable and let a jury make a decision as to what is proper in this case."

Gwynn died back in 2014 of complications from salivary gland cancer.
