Jury acquits California man in death of girlfriend’s child

VENTURA, Calif. (AP) — A jury has found a Southern California man not guilty of murder in the death of his girlfriend’s 3-year-old son.

The Ventura County Star reports 40-year-old Caleb Burrett was also acquitted Thursday of assault on a child causing death.

Dylan Spinks suffered injuries in September 2014 inside a Camarillo apartment that his mother shared with Burrett. The boy died at a hospital.

Burrett and his girlfriend later married and moved to Colorado. An investigation into the death led to his arrest and extradition back to California.

The defense pointed to evidence from the medical examiner’s office, which found that the manner of death could not be determined as a homicide. The defense said investigators found the injuries were consistent with an accidental fall.

The district attorney’s office did not return a request for comment.
