Judge presiding over CPUC case has been removed

SAN DIEGO (KUSI) – A major shift in the case involving the San Onofre Nuclear Power Plant.

The judge that has been presiding over the case has been removed.

Presiding Justice J. Anthony Kline, considered one of Governor Jerry Brown’s oldest friends, is no longer handling the case involving Brown’s communications with the Public Utilities Commission.

Last month, Kline abruptly blocked a superior court judge’s declaration that the communications were part of the state’s open record laws.

That action drew fire from attorneys seeking the emails who are fighting against the CPUC that ratepayers should bear 70 percent of the costs of shutting down the San Onofre Nuclear Generating Station.

One of the attorneys involved, former San Diego City Attorney Mike Aguirre, sat down with KUSI with more on this story.
