Update: Mar Vista ROTC teacher accused of sex with student pleads not guilty

SOUTH BAY (KUSI) — 4/12/2016 — Martin Albert Gallegos, a substitute teacher and ROTC instructor at Mar Vista High School in Imperial Beach, who’s accused of having sex with an underage student, pleaded not guilty Tuesday to a pair of felony charges.

Gallegos, 48, faces nearly four years in prison if convicted of sexual penetration by a foreign object and oral copulation of a person under 18.

Gallegos, who remains free on $50,000 bail, will be back in court May 31 for a readiness conference and June 14 for a preliminary hearing.

He was arrested April 9, one day after a campus police officer got a report about the alleged crimes, said sheriff’s Lt. Dan Brislin.

The lieutenant declined to disclose the age of the student, who is a senior at the Elm Avenue school. Detectives believe the alleged sexual relationship had been going on for roughly a month or six weeks, Brislin said.

Gallegos is one of three people who worked at Mar Vista High School who were charged recently with having sex with underage students.

1:40 a.m. — A substitute teacher and ROTC instructor at Mar Vista High School who has been accused of having sex with an underage student will be arraigned Tuesday. 

Martin Albert Gallegos is suspected of five counts of non-forcible sexual conduct with the girl. He posted bail last week after being booked into county jail, according to sheriff’s officials. The age of the student has not been disclosed but she is a senior at the school, Lt. Dan Brislin said.

The arrest was made after a campus police officer at the school received a report about the crimes alleged against Gallegos, Brislin said.

Gallegos worked for the Sweetwater Union High School District since last fall, filling in periodically for full-time teachers, according to SUHSD spokesman, Manny Rubio. 

4/11/16 — A 48-year-old substitute teacher at a high school in South Bay was arrested Saturday for allegedly having sex with an underage student, authorities said Monday. Martin Albert Gallegos was booked into county jail on suspicion of five counts of sexual conduct with the girl, according to sheriff’s officials. 

Gallegos has since posted bail and his initial court hearing is set for Apr. 19. Information on the age of the student was not released, but she is a senior at the school. 

The arrest was made after a campus police officer at the school received a report about the crimes alleged against Gallegos on Friday, Lt. Dan Brislin said. Sweetwater Union High School District officials are in the process of terminating his employment following the arrest, SUHSD spokesman Manny Rubio said. Gallegos has worked for the district dating back to last fall as a substitute teacher, according to Rubio. The suspect is an ROTC instructor at Mar Vista High School in Imperial Beach.
